ORDINANCE 1996-14

TOWN OF COCHITI LAKE

An Ordinance Establishing the position of Town Treasurer, establishing the duties and responsibilities thereof, providing for appointment to the position, providing for the person serving in the position to serve at the pleasure of the Mayor and Assembly.

BE IT ORDAINED BY THE TOWN ASSEMBLY OF THE TOWN OF COCHITI LAKE:

Section l. OFFICE CREATED.

            There is hereby created the office of the Town Treasurer.

Section 2.  APPOINTMENT AND SELECTION GENERALLY.

            The mayor shall appoint with the consent of the Town Assembly, a person who shall be responsible for the proper and efficient administration of the office of the Town Treasurer of the Town of Cochiti Lake.  The Town Treasurer shall be appointed solely on the basis of qualifications and the selection shall not be limited by reason of former residence.

Section 3.  OATH; BOND.

            The Town Treasurer shall take an oath or affirmation to support the Constitution of the United States, the Constitution and Laws of New Mexico and to faithfully perform the duties of the office in conformance with NMSA 1978 3-10-2 and 3-13-1; and within ten (10) days of such oath or affirmation, shall furnish a surety bond to the Town Assembly in the amount prescribed by the Town Assembly.  The Town of Cochiti Lake shall pay for the surety bond.

Section 4. COMPENSATION.

The Town Treasurer shall receive such compensation as shall be determined from time to time by resolution of the Town Assembly.

Section 5.  QUALIFICATIONS.

            The Town Treasurer shall have an accounting or bookkeeping background, either by virtue of education, training or experience, or a combination thereof in education, training and experience in other fields allied to administering municipal financial records and shall have two (2) years experience in administration, preferably in or related to general municipal government.

Section 6.  DUTIES.

            The Town Treasurer of the Town of Cochiti Lake shall:

            (1)  be custodian of all public funds, which shall not be construed to include the Cochiti Lake Improvement Trust Fund, belonging to or under the control of the Town, or of any office, department or agency thereof, and shall have the power and be required to:

            (a) received and have custody of all monies receivable by the Town from any source;

            (b) deposit  all monies received in such depositories as may be designated by resolution of the Town Assembly and in compliance with all other applicable laws;

            (c) disburse money on demands properly audited in the manner provided in the Charter of the Town of Cochiti Lake;

            (d) prepare and submit to the Town Assembly monthly written reports of all receipts, disbursements and fund balances;

            (e) maintain a general accounting system for the Town government and each of its offices, departments and agencies;

            (g) audit and approve before payment all bills, invoices, payrolls, demands or charges against the Town government, and, with the advice of the Town Attorney when necessary, determine the regularity, legality, and correctness of such claims demands or charges;

            (h) assess property within the Town for purposes of ad valorem property taxes; and

            (I) perform all the necessary functions of tax collector.

            (2) The Town Treasurer shall further perform such other duties reasonably related to the position of Town Treasurer as may be specified by the Mayor or Town Assembly.

            (3) The Mayor, with the consent of the Town Assembly body may designate other municipal employees to be Deputy Town Treasurers who shall have the right and duty to perform all of the duties of the Town Treasurer.

Section 7.  APPOINTMENT.

            The Town Treasurer shall be appointed by the Mayor with advice and consent of the Town Assembly.

Section 8.  SERVES AT THE PLEASURE OF THE TOWN ASSEMBLY.

The Town Treasurer serves at the pleasure of the Town Assembly and may, subject to the terms of any written employment contract, be removed by the Town Assembly at any time with or without cause.

Section 9.  EFFECTIVE DATE.

This Ordinance shall become effective thirty (30) days after adoption and publication as provided by law.
