ORDINANCE 1996-13

                                               TOWN OF COCHITI LAKE

An Ordinance Establishing the position of Town Clerk.,
establishing the duties and responsibilities thereof, providing for appointment to the position, providing for the person serving in the position to serve at the pleasure of the Mayor and Assembly
.

BE IT ORDAINED BY THE TOWN ASSEMBLY OF THE TOWN OF COCHITI LAKE:

Section 1.  OFFICE CREATED.

            There is hereby created the office of the Town Clerk.

Section 2.  APPOINTMENT AND SELECTION GENERALLY.

            The mayor shall appoint with the consent of the Town Assembly, a person who shall be responsible for the proper and efficient administration of the office of the Town Clerk of the Town of Cochiti Lake.  The Town Clerk shall be appointed solely on the basis of qualifications and the selection shall not be limited by reason of former residence.

Section 3.  OATH: BOND.

            The Town Clerk shall take an oath or affirmation to support the Constitution of the United States, the Constitution and Laws of New Mexico and to faithfully perform the duties of the office in conformance with NMSA 1978  3-10-2 and 3-13-1; and within ten (10) days of such oath or affirmation, shall furnish a surety bond to the Town Assembly in the amount prescribed by the Town Assembly.  The Town of Cochiti shall pay for the surety bond.

Section 4. COMPENSATION.

            The Town Clerk shall receive such compensation as shall be determined from time to time by resolution of the Town Assembly.

Section 5.  QUALIFICATIONS.

The Town Clerk shall have a business background, either by virtue of education, training or experience, or a combination thereof in education, training and experience in other fields allied to municipal administration and shall have two (2) years experience in administration, preferably in or related to general municipal government.

The Town Clerk shall at the time of appointment be a New Mexico Certified Municipal Clerk.  If the Town Clerk is not a New Mexico Certified Municipal Clerk, he or she shall begin the process of certification immediately upon employment and shall become certified within four (4) years of appointment.

Section 6.  DUTIES.

            The Town Clerk of the Town of Cochiti Lake shall:

(1)  attend all meetings of the Town Assembly and record a full and true record  of all the proceedings of the Town Assembly in books that shall bear appropriate titles and be devoted to

such purposes.  Such books shall have a general index sufficiently comprehensive to enable a person readily to ascertain matters contained therein;

(2) maintain ordinance and resolution books, into which shall be recorded all Town ordinances and Resolutions with the certificate of the Town Clerk annexed to each thereof stating the same to a correct copy,  and giving the number of said ordinances or resolutions;

(3) take affidavits or depositions pertaining to the affairs and business of the Town;

(4) certify copies of official records, and provide copies of municipal records upon request, charging such fees for such services as may be authorized from time to time by the Town Assembly;

(5) perform all duties of the municipal clerk required by the Municipal Election Code (NMSA 1978 Chapter 3, Articles 8 and 9);

(6) perform such other duties reasonably reasonably related to the position of Town Clerk as may be specified by the Mayor or Town Assembly; and

 

(7) the Mayor, with the consent of the Town Assembly may designate other municipal employees to be Deputy Town Clerks who shall have the right and duty to perform all the duties of the Town Clerk.

Section 7.  APPOINTMENT.   

            The Town Clerk shall be appointed by the Mayor with the advice and consent of the Town Assembly.

Section 8.  SERVES AT THE PLEASURE OF THE TOWN ASSEMBLY.

            The Town Clerk serves at the pleasure of the Town Assembly and may, subject to the terms of  any written employment contract, be removed by the Town Assembly at any time with or without cause.

Section 9.  EFFECTIVE DATE.

            This Ordinance shall become  effective thirty (30) days after adoption and publication as provided by law.
